Terms of Use

These Terms of Use ("Terms") are an agreement between you and Peppy Panda Health Inc., an Iowa corporation ("Peppy Panda," "we," "us"), covering your use of the Peppy Panda mobile app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. The Service

Peppy Panda is a wellness companion for people on a bariatric surgery or GLP-1/GIP medication weight-loss journey. It offers AI-assisted logging of food, water, activity, mood, supplements, and weight, along with progress tracking and, optionally, syncing with Apple Health or Health Connect. AI-generated estimates (such as calories and nutrients) can be wrong; please review what's logged.

2. Eligibility

You must be at least 18 years old to use the Service.

3. Your account

Keep your login credentials secure — you're responsible for activity under your account. You can delete your account at any time in the app (Profile → Privacy → Delete account) or as described at peppypandahealth.com/delete-account.

4. Free trial, free plan, and Peppy Panda Plus

• Free trial. New accounts get a free trial period (currently 14 days) with the same daily chat allowance as Peppy Panda Plus. No payment details are needed for the trial, and it does not turn into a paid subscription on its own.
• Free plan. After the trial, you can keep using Peppy Panda for free with a smaller daily number of chats with Peppy. Your logs and data are never deleted because you're on the free plan.
• Peppy Panda Plus. A paid subscription that raises your daily chat allowance. Daily allowances aren't fixed numbers: they reset at midnight in your local time zone, and the app tells you when you're running low. We may adjust plan features and allowances from time to time to keep the Service sustainable; if a change reduces what a Plus subscription includes, it applies from your next renewal and we'll let you know in the app beforehand.

5. Subscriptions, billing, and cancellation

• Payment. Peppy Panda Plus is sold through the Apple App Store or Google Play. Payment is charged to your Apple ID or Google Play account when you confirm the purchase, at the price shown in the app before you buy.
• Automatic renewal. Your subscription renews automatically at the end of each period (monthly or yearly) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Cancelling. You can cancel or change your plan anytime in your Apple ID or Google Play subscription settings (also reachable from the app's subscription screen). Cancelling stops future renewals; you keep Pro until the end of the period you've paid for. Deleting the app or your Peppy Panda account does not cancel a subscription — please cancel it in your store account too.
• Refunds. Purchases are handled by Apple or Google, and refund requests are subject to their policies: Apple at reportaproblem.apple.com, Google through your Google Play order history. If a refund is granted, Pro access ends.
• Price changes. If we change the price of a subscription, Apple or Google will notify you as their rules require before it applies to your renewal.

6. Acceptable use

Don't misuse the Service — for example, by trying to break or overload it, getting around usage limits, reverse-engineering it, or using it to harass others or post content that's abusive or medically dangerous. We may limit, suspend, or close accounts that violate these Terms.

7. Your content

You own what you log and the messages you send. You give us permission to store, process, and use it to provide and improve the Service as described in our Privacy Policy.

8. Intellectual property

The Service, including its design, user interface, branding, and content, is © Peppy Panda Health Inc. All rights reserved. Except as needed to use the Service as intended, you may not copy, modify, distribute, or create derivative works from it without our written permission.

9. Apple App Store

If you downloaded the app from the Apple App Store, these Terms are between you and Peppy Panda Health Inc., not Apple. Apple has no obligation to provide maintenance or support for the app, and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's standard Licensed Application End User License Agreement also applies, except where these Terms provide otherwise.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Peppy Panda Health Inc. is not liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.

11. Changes

We may update these Terms as the Service evolves. When we make material changes, we'll update the date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
